Order to Show Cause
An Order to Show Cause is a procedural device used to ask the court for certain relief. It is used rather than a Notice of Motion when some form of emergency relief is being requested of the court. These emergency applications are signed by a judge requiring a party to appear and "show cause" why an order granting the requested relief should not be granted.
An Order to Show Cause usually provides a short time frame to respond. The time frames set forth in the Order to Show Cause should not be ignored because, as the title of this document clearly denotes, this document is an order of the court.
