Default Judgment

A default judgment is a judgment against a defendant who has failed to appear in a case. Sometimes a party is aware of a lawsuit and chooses not to appear and defend themselves in the action. Other times a party learns about the lawsuit only after the plaintiff has commenced post judgment collection proceedings against the defaulting defendant. These post judgment collection proceedings can be in the form of seizure of goods by the sheriff, garnishment of wages, or liens placed on property. 

Once a defendant has notice that there is a default judgment against them, they are sometimes able to vacate the default. One way is to bring a motion to vacate the default. A motion to vacate a default is not as simple as many people are led to believe. These motions must be supported with meritorious and persuasive legal arguments in order to be successful.
