About New York Appeals
When you are seeking to overturn an adverse decision from a New York State trial court, your appeal will need to be filed in one of the four lower appellate courts in the state. In most circumstances, the first level of appeal will be heard in either the First Department, Second Department, Third Department or Fourth Department. These departments cover certain regions in NY State and the location of the trial court will determine which appellate court will hear your case.
NY also has an additional appellate level - the New York Court of Appeals. The Court of Appeals hears cases of statewide importance. While some appeals can be taken as of right to the Court of Appeals, most often the appellant must be granted permission to appeal to the State's highest court.
